Welcome to StrikeZone. These Terms of Use (“Terms”) govern your access to and use of the StrikeZone platform, website, services, applications, APIs, and associated content (collectively, the “Services”) operated by StrikeZone, Inc. (“StrikeZone,” “we,” “our,” or “us”).
By accessing or using any part of the Services, you agree to these Terms. If you do not agree, do not use our Services.
1. Eligibility
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. You represent and warrant that all information you provide to us is accurate and that you are authorized to use our Services on behalf of your business.
2. Use of the Services
StrikeZone provides software tools to modernize outdated marketing automation, CRM analytics, go-to-market (GTM) planning, and sales workflows. You agree to use the Services only for lawful purposes and in accordance with all applicable laws and regulations.
You may not:
- Use the Services for any illegal, harmful, or abusive purposes.
- Attempt to reverse engineer, decompile, or access any part of our code or systems without authorization.
- Access or use the Services to compete with StrikeZone or build a similar product.
3. Account Registration and Security
To use certain features, you must register an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Intellectual Property
All content, features, methodologies (including the GTM, ICP, and Buyer Personas frameworks developed by Frank Robinson and Thomas Knapp), software, and documentation provided by StrikeZone are the intellectual property of StrikeZone and/or its licensors.
You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Services without our express written permission.
5. Data Rights and Privacy
You retain ownership of any data you upload or input into the StrikeZone platform. We collect, store, and use data in accordance with our Privacy Policy and Cookies Policy.
You grant StrikeZone a non-exclusive, worldwide license to process and analyze your data solely for the purpose of delivering the Services to you.
6. Confidentiality
Certain StrikeZone features involve proprietary methods and confidential business data, including our MVP Charter Customer Program and ICP/BP methodologies. You agree not to disclose or use any confidential information for purposes outside the scope of these Terms.
7. Third-Party Services and Integrations
StrikeZone may integrate with third-party services like HubSpot, Salesforce, or Zoho. We are not responsible for the practices, content, or reliability of any third-party services or data connectors.
8. Termination
We may suspend or terminate your access at any time, with or without cause, and without liability to you. You may terminate your account at any time by contacting support.
9. Disclaimers
StrikeZone is provided “as is” and “as available.” We do not guarantee that the Services will be uninterrupted, error-free, or suitable for your specific needs. Your use of the Services is at your sole risk.
10. Limitation of Liability
To the maximum extent permitted by law, StrikeZone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly.
11. Indemnification
You agree to indemnify and hold StrikeZone harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of these Terms.
12. Modifications
We may update these Terms from time to time. Changes will be effective upon posting the updated Terms on our website. Continued use of the Services after changes constitutes your acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
